Fine for non-return of foreign currency funds to be changed

June 23, Fineko/abc.az. The fine for non-return of foreign currency funds will be revised, and a case of exemption from liability will be provided.

ABC.AZ informs that this is reflected in the proposed amendment to the Code of Administrative Offenses, discussed at a joint meeting of the Milli Majlis Committees on Legal Policy & State Building, as well as on Social Policy & Labor.

According to the current legislation, a fine of 30% to 50% of the value of the currency that is the direct object of the administrative offense is imposed for the non-return of small amounts of foreign currency that were received as a result of foreign economic activity and are subject to mandatory transfer to the accounts of authorized banks in Azerbaijan. A "small amount" refers to  sum of up to 20,000 manats.

Under the draft, term "small amount" is excluded from the disposition, the penalty is reduced, and a case of exemption from administrative liability is established. In other words, officials will be fined between 10% and 20% of the value of the foreign currency funds that are the direct object of the offense, and legal entities will be fined between 20% and 30%.
