June 23, Fineko/abc.az. Persons who have committed certain economic crimes will be exempted from liability if they fully compensate for the damage caused or fully transfer to the State Budget the income received as a result of the crime.
ABC.AZ reports that the relevant amendments are proposed to the Criminal and Criminal Procedure Codes.
The draft was put up for discussion at today's joint meeting of the Milli Majlis committees on legal policy & state building, as well as on social policy & labor.
According to the draft, individuals who commit certain crimes in the field of economic activity (illegal entrepreneurship, fictitious entrepreneurship, restriction of competition, etc.) and fully compensate for the damage caused or fully transfer the income obtained as a result of the crime to the State Budget, as well as additionally pay 50% of the amount of damage (income) to the budget, will be exempted from criminal liability.
According to the document, fictitious entrepreneurship (Article 193 of the Criminal Code) will be understood not only as the creation of a legal entity without the intention to engage in entrepreneurial activities in order to illegally obtain a loan, exempt from fees, or obtain other property benefits, or conceal prohibited activities, but also as the actual management of a legal entity or a registered individual entrepreneur for these purposes.
