Chamber of Private Judicial Experts under creation in Azerbaijan

October 5, Fineko/abc.az. A proposed bill on amendments to the Law on Forensic Expertise has been submitted for discussion at a meeting of the Milli Majlis Committee on Legal Policy & State Building.

According to the amending draft, the Chamber of Private Judicial Experts with the status of a non-profit legal entity operating on the principles of self-government will be established on the basis of the mandatory membership of private judicial experts.

The financial sources of the Chamber, which will be headed by the chairman of board, include membership fees, disciplinary fines and donations. Individuals will become members of the Chamber from the moment they are entered into the Register of Judicial Experts, and upon termination of their activities, they will be excluded from membership.

The Chamber will have the following powers:

* Coordination of the activities of private experts;

* Support during exam preparation and training;

* Monitoring compliance with the Code of Ethics;

* Making submissions to initiate disciplinary proceedings;

* Representation of experts in government agencies;

* Making proposals to improve legislation.

According to the transitional provisions, prior to the state registration of the Chamber, its powers will be performed by the relevant executive authority, and membership fees will be transferred to a special treasury account of the justice authorities. The Chamber is established by private experts included in the Register of Judicial Experts; if the number of experts does not reach 50 by July 1, 2027, the constituent assembly is held with the participation of at least two thirds of them, and if it is not established within a year, the meeting is convened by the relevant government agency.
