October 5, Fineko/abc.az. The Milli Majlis Committee on Legal Policy & State Building has submitted for discussion a new Bill on Free Legal Aid, consisting of 5 chapters and 14 articles.
The draft law defines the organizational, legal and economic foundations of free legal aid in order to protect human rights and freedoms and ensure the availability of high-quality legal aid.
According to the document, the services will be rendered at the expense of finances allocated to the Bar Association from the State Budget, as well as within the "pro bono" (free) services, which lawyers must provide for at least 30 hours during the year.
Under law, the right to receive professional free legal aid primarily applies to low-income people who are financially unable to pay for services - family members receiving targeted state social assistance, unemployed people with disabilities and those registered as officially unemployed.
Other persons from the special category will also be able to use this right. This includes family members of martyrs, war veterans, minors, persons deprived of parental care, victims of human trafficking, victims of domestic violence, persons who reported corruption, refugees and persons granted political asylum, persons released from correctional institutions (within 1 year), and persons under probation supervision.
Primary and professional legal assistance will be organized by the Presidium of the Bar Association and will be provided by lawyers, paralegals, legal assistants and law clinics of higher educational institutions. Persons with disabilities will also be provided with free sign language interpreter and reader services.
