Azerbaijan amends to Law on Public Procurement

July 13, Fineko/abc.az. The Milli Majlis of Azerbaijan adopted in the 3rd reading the amendments to the Law on Public Procurement that determine the mechanism for exempting foreign suppliers from the obligation to provide security for the execution of the contract and advance payment.

The bill was considered at today's plenary session of the parliament.

According to the changes, non-resident legal entities and individuals will be able to apply to the procurement commission with a reasoned application for exemption from the obligation to submit, together with the procurement proposal, the enforcement of the contract and (or) an advance payment.

In addition, when using the single-source procurement method, the procurement commission will be able to determine whether it is impossible for a non-resident to provide appropriate collateral. Such a decision can be made either on the initiative of the commission itself, or on the basis of an application received.

In this case, the procuring entity will have to contact the relevant government agency within 10 working days.

The authorized body, in turn, will make a final decision within 20 business days on the basis of the control body's proposals.

If the same purchasing organization buys the same item from the same supplier within 12 months of the release decision, a new release decision will not be required.
