Nord Stream 2 Sues European Union Over Permanent Ban on Russian Gas Imports

June 15, Fineko/abc.az. Nord Stream 2 AG, the corporate operator of the controversial Baltic Sea gas pipeline and a subsidiary of Russia’s Gazprom, has filed a formal lawsuit at the Court of Justice of the European Union seeking to overturn the bloc's permanent ban on Russian gas.

According to ABC.AZ, tracking the official EU General Court registry, the legal challenge targets both the European Parliament and the Council of the EU over newly enacted regulations mandating the structural phase-out of Russian pipeline and liquefied natural gas (LNG) imports.

Key Assertions Made by Nord Stream 2 AG:

  • Demand for Annulment: The pipeline consortium demands the immediate lifting of clauses blocking commercial pipeline deliveries.

  • Abuse of Competence: The plaintiff argues the regulation relies on flawed legal foundations, circumvents standardized EU sanctions framework legislation, and directly violates the core principle of proportionality.

  • De Facto Expropriation: The firm states that the rigid import ban completely strips it of the capacity to operate its multi-billion-euro maritime infrastructure, amounting to "expropriation of property without financial compensation."

  • Discriminatory Treatment: Nord Stream 2 AG alleges that EU authorities have enforced highly non-uniform and discriminatory metrics against its system compared to secondary international pipeline operators.
