July 14, Fineko/abc.az. Insurance payments will be made not on the basis of the insured person's disability, but according to the degree of their professional disability.
This is reflected in the proposed amendment to the Law on Compulsory Insurance against Loss of Professional Disability Due to Industrial Accidents & Occupational Diseases, submitted for discussion at today's Milli Majlis session.
The degree of loss of professional capacity is percentage-based stable loss of the insured person's professional capacity that they had before the insured event. In this regard, in order to assess the provision of insurance benefits for an insured event based on a single criterion, it is also proposed to link the one-time insurance payment not to establishment of disability for the insured person affected by the insured event, but to the degree of loss of professional capacity. In other words, a one-time insurance payment will be made if the degree of loss of professional capacity of the insured person who was injured in an insured event is determined without specifying the date of the next examination.
The loss of professional capacity also includes determination of disability, which is the loss of bodily functions. This change also complies with the requirements of Article 4 of the International Labour Organization Convention #187 on the Fundamentals Promoting Safety and Health at Work.
The draft law was put to a vote and passed in the third reading.
