November 15, Fineko/abc.az. Sometimes the POS-terminal does not work at service and catering facilities. In this case, sellers usually ask buyers to either cash out the payment or drop it on the card, which is a violation of the law. In accordance with the requirement of the Law, the consumer has every right to require the seller to provide a POS-terminal for making a payment.

ABC.AZ reports that the State Tax Service also informed that making non-cash payments at retail and catering facilities not through POS-terminals, but by transferring "from card to card" is a violation of both legislation and consumer rights. In particular, this restricts some basic rights of the buyer when making a purchase.

The STS informs that this violation is mainly aimed at tax evasion.

It was noted that additional taxes, interest and financial sanctions may be imposed on entrepreneurs who have committed these operations by the tax authority.

During a calendar year, upon the first admission of such cases, a fine of 1,000 manats is applied to entrepreneurs, in the second case – 3,000 manats, in three or more cases – 6,000 manats.
