Azerbaijan Updates Code of Administrative Offenses: New Fines for Cybersecurity, Seed Production, and Currency Returns

September 2, Fineko/abc.az. President Ilham Aliyev has approved amendments to the Code of Administrative Offenses, introducing new penal enforcement measures regarding cybersecurity compliance, seed production standards, and foreign currency repatriations.

Key regulatory changes under the new legislation include:

  • Cybersecurity Standards: Internet service providers, host providers, and information infrastructure operators that fail to implement continuous monitoring, delay incident reporting, or do not respond to inquiries within designated timeframes (24 hours or 5 business days) will face fines up to 1,000 AZN for officials and up to 2,000 AZN for legal entities.

  • Seed Trade Regulations: Non-compliance with seed quality standards, unauthorized operations, or providing false product information on packaging will draw fines ranging from 100 AZN to 1,500 AZN depending on the entity category.

  • Repatriation of Foreign Currency: Penalties for failing to repatriate foreign currency revenues into authorized domestic bank accounts have been revised to 10–20% for officials and 20–30% for legal entities. The law introduces a waiver of administrative liability if the funds are returned before a final administrative decision is rendered.
