Azerbaijan to take into account rights of all heirs when issuing inheritance certificate

July 7, Fineko/abc.az. President of Azerbaijan Ilham Aliyev has approved the amendments to the Land, Civil Procedure and Civil Codes, as well as the Laws on Notary Office and on Enforcement, adopted by Milli Majlis on June 21.

ABC.AZ informs that according to the amendments, in Azerbaijan, the rights of all heirs, including those who have not applied for it, will be taken into account when issuing an inheritance certificate.

As amended, when issuing a certificate to an heir who has applied for inheritance registration, a notary is required to determine and indicate the shares of all co-heirs, even if they have not submitted an application.

This information, including data about heirs and their shares (in accordance with Article 1325.2 of the Civil Code), will be entered by authorized bodies into the registers of immovable and movable property.

Each co-heir will subsequently be able to receive a separate certificate for his share, as determined by law.
The amending bill also notes that co-heirs provided for in Article 1325.2 of the Civil Code have the right to dispose of their shares. These persons may dispose of their share on the basis of a notarized contract before receiving a certificate of inheritance.

The share of the heir who has received his share of the inheritance on the basis of an agreement on the disposal of shares between co-heirs increases according to the proportion of the share received, and his final share is indicated in the inheritance certificate.
