October 18, Fineko/abc.az. In case of loss or destruction of baggage or cargo, the carrier will pay its full cost.
ABC.AZ reports that this was reflected in the new Draft Law on Aviation, discussed at today’s meeting of the Parliamentary Committee on Economic Policy, Industry & Entrepreneurship.
Under the draft, if the baggage or cargo is not delivered by the carrier within three months from the moment they are accepted for carriage, they will be considered lost until proven otherwise. In addition, the carrier is liable for any damage related to delayed delivery, damage or partial destruction.
When determining the scope of the carrier's liability in cases of loss, damage, shortage, late delivery of baggage or part of the cargo to the destination, only the weight of the baggage or cargo is taken into account. When determining the amount of liability, the total weight of all parcels is taken into account if the loss, damage, shortage or untimely delivery of the parcel (parcels) to the destination, including the items contained therein, affected the cost of other parcels and their contents included in the corresponding baggage receipt, baggage bill or postal receipt.
The carrier is released from liability if he or his representatives appointed in accordance with the procedure established by law prove that the above damage was caused as a result of force majeure.
