Major Property Reform in Azerbaijan: State Land Can Now Be Exchanged for Private Property

August 17, Fineko/abc.az. President of Azerbaijan Ilham Aliyev has approved amendments to the Land Code, Civil Code, and the Law on Valuation Activity.

The legislative amendments establish a legal foundation allowing state-owned property (including state land) to be exchanged for privately owned property or land plots based on mutual consent.

However, state property and land prohibited from privatization, as well as land under exclusive state ownership or reserved for state needs, are strictly excluded from exchange eligibility.

Valuations of exchanged properties will be conducted by certified appraisers in accordance with prevailing market prices. Additionally, state authorities and municipalities have been granted the status of clients for valuation services. The precise rules governing the exchange procedure will be formally approved in due course.

These changes are aimed at boosting land market turnover, stimulating economic activity, and ensuring equal terms for state and private entities within civil commerce.
