April 21, Fineko/abc.az. Penalties for misuse of funds of state-owned legal entities are determined in Azerbaijan.
ABC.AZ informs that this is reflected in the amendments to the Criminal Code, discussed at today's meeting of the Milli Majlis.
Speech is about expanding the scope of Article 308-1 of the Criminal Code (misuse of State Budget funds, targeted budget funds or extra-budgetary state funds). In particular, it is proposed to include funds of legal entities owned by the State in the subject of the crime.
In the current version of the Article, the fine is set in a fixed range - from 9,000 to 13,000 manats. According to the bill, the fine will be determined in the amount of 100% of the value of the object of the crime, that is, the amount of funds used for other purposes. Thus, the amount of punishment will directly depend on the damage caused. In addition, for acts committed on a large scale, an alternative punishment is imposed - restriction of liberty for up to 3 years.
The bill also clarifies which structures fall under the concept of "state-owned legal entities". Speech is about commercial companies, 51% or more of which are directly or indirectly owned by the state, as well as non-profit organizations and public legal entities created by the State. Their subsidiaries, non-profit organizations, and public legal entities are also included in this category if 51% or more of their shares are owned directly or indirectly by these entities.
According to another amendment, a person who commits such an offense for the first time will be released from liability in case of full compensation for the damage caused.
