July 12, Fineko/abc.az. The State Service for Antimonopoly Control & Consumer Market Control has completed consideration of the case against Azerbaijan Railways CJSC (ADY).
ABC.AZ informs with reference to the State Service that the Service conducted an investigation based on complaints received from business entities about the unjustified restriction of business entities in the market of forwarding services and container transportation and creation of conditions for dumping against them, discrimination in concluding contracts, mandatory acceptance of terms of the contract unfavorable to the counterparty, which entails restriction of competition in the market. As a result, a case was initiated on grounds of violation of antimonopoly legislation in relation to Azerbaijan Railways (ADY).
During the consideration of the case, it was revealed that ADY, which is a natural monopoly entity in a certain area, unreasonably refused orders for the transportation of goods to business entities, created conditions for the use of dumping during the transportation of goods and special benefits for the use of infrastructure by a subordinate business entity. It was found that competitive advantages were provided to subsidiaries of a natural monopoly entity, which limited the opportunities for the activities and competitiveness of other business entities.
On the basis of violation of the requirements of the Law on Antimonopoly Activity, on June 24, 2024, a financial sanction in the amount of 246,241 manats was imposed on Azerbaijan Railways, as well as a number of mandatory instructions were given in order to eliminate cases of industry monopoly in a particular market.
